Canada Spousal Buyout Mortgage 2026: Refinance Up to 95% LTV During Separation

Related Questions

How do you structure a 95% LTV refinance for a buyout?

Technically, this is structured as a 'Purchase' from one spouse to another, which is why it qualifies for 95% LTV (insured) instead of the 80% (conventional) refinance cap.

What are the core 2026 documentation requirements?

Lenders will not touch a buyout file without a final, signed Separation Agreement.

What is the biggest risk in a spousal buyout file?

The single most common failure point is the 'Income Gap.' Most families qualify for their home on two incomes; qualifying on one income while paying support is extremely difficult under the stress test.

How does the 95% LTV spousal buyout refinance work?

Under CMHC, Sagen, and Canada Guaranty guidelines, a separating spouse can refinance up to 95% LTV to buy out the other's equity share.

A spousal buyout does not by itself create first-time buyer status. Insured 30-year amortization is available only when that borrower meets the first-time buyer test, or the home is newly built, under CMHC Home Start.

Finance Canada's September 16, 2024 parameters, effective for insurer applications on or after December 15, 2024, treat someone as a first-time homebuyer only if they have never purchased a home, have not occupied a home that they or their current spouse owned as a principal residence in the current year or the four preceding calendar years, or recently had a marriage or common-law partnership break down on the Home Buyers' Plan approach. A buyout file still has to meet one of those tests. The loan also has to be high-ratio ((/glossary/loan-to-value) over 80%), owner-occupied, and priced below $1,500,000. CMHC calls that product Home Start.

If those tests are not met, the insured maximum stays 25 years. An uninsured mortgage is outside that cap. Its amortization is the lender's decision, and 30 years is commonly available.

A buyout can still be insured up to 95% loan-to-value when the insurer's buyout rules are met. That higher loan-to-value is separate from the 30-year term.
